California State Judge Rules Against Stop QIP

On July 31 after a one-day court hearing in Sacramento, Calif., a state supreme court judge has ruled against the Stop QIP group that is seeking to immediately abolish the California milk quota program. The group had sued the CDFA contending that the quota program had not been properly established, and therefore should be ended immediately with no financial consideration given to quota holders.

Judge James P. Arguelles acknowledged there are strong feelings in the dairy industry about quota but said his decision was not about the merits but rather on the procedures followed by CDFA. He ruled the program was properly established under the law that had been passed when the California FMMO went into effect in November 2018.
