The H-1B visa has been utilized by many dairy farmers, typically to bring in foreign managers. It’s not the easiest of processes–with one large concern always being the random cap lottery.
Tomorrow, on January 8th, the Department of Homeland Security (DHS) will publish a final rule with a new system that will allocate H1-B visa numbers by a four-level wage system from the Department of Labor’s Occupational Employment Statistics. This will give priority to those applicants coming in with the highest wage level for their occupation and geographic area.
The ruling would take effect within 60 days (mid-March, prior to the April 1st deadline for filing). However, again, President Elect Biden could be placed on hold–or challenged in federal court.
